The study of the excessive breaking off trade relations enables us to bring out a thinking on two central themes : the factual building up of the breaking off and its implications. We need therefore to determine the object of the breaking off and the modalities of the abuse before bringing out its manifestations the juridiction of the right to break off implying only to control the way to break off . As the loyalty imperative forbids evrery discretionary use of the right to break off, the abuse can be induced by the motives and the circumstances of the breaking off. The autority of the right to break off requires to compensate through the only damages caused by its excessive use. Determining the harm implies considering the potential dependency of the dismissed, identifying specifically the charges and the most appropriate mode of compensation. The issue of the action¤s liability commands once again to optimize the legal system. The loyalty imperative finally induces to insure the economical survival of the dismissed and the maintain of the dismissing¤s interests
